Artikel 48 WvSr:

Als medeplichtigen van een misdrijf worden gestraft:
1°. zij die opzettelijk behulpzaam zijn bij het plegen van het misdrijf;
2°. zij die opzettelijk gelegenheid, middelen of inlichtingen verschaffen tot het plegen van het misdrijf.


Artikel 148 wvmsr:

De militair, die opzettelijk toelaat, dat een mindere een misdrijf pleegt, of die, getuige van een door een mindere gepleegd misdrijf, opzettelijk nalaat maatregelen te nemen, voorzover die nodig zijn en van hem kunnen worden gevergd, wordt gestraft als de medeplichtige.
