Artikel 213 Boek 6 BW:

1Een overeenkomst in de zin van deze titel is een meerzijdige rechtshandeling, waarbij een of meer partijen jegens een of meer andere een verbintenis aangaan.
2Op overeenkomsten tussen meer dan twee partijen zijn de wettelijke bepalingen betreffende overeenkomsten niet toepasselijk, voor zover de strekking van de betrokken bepalingen in verband met de aard van de overeenkomst zich daartegen verzet.


Artikel 226 Boek 6 BW:

Stelt de wet voor de totstandkoming van een overeenkomst een vormvereiste, dan is dit voorschrift van overeenkomstige toepassing op een overeenkomst waarbij een partij in wier belang het strekt, zich tot het aangaan van een zodanige overeenkomst verbindt, tenzij uit de strekking van het voorschrift anders voortvloeit.
