bestuursrecht - onrechtmatig en inbreukmakend handelen of nalaten van de overheid; bij de vraag of er sprake is van een onrechtmatige daad toetst de rechter het besluit van het overheidsorgaan om te handelen (of na te laten) op de vraag of het overheidsorgaan alle belangen in aanmerking heeft genomen en of het overheidsorgaan in redelijkheid had kunnen komen tot het litigieuze besluit. Bij de toetsing gaat het ook om de vraag of het overheidshandelen valt binnen de beleids- of beoordelingsvrijheid van die overheid of dat bestuursorgaan. Die vrijheid vloeit voort uit de wettelijke regeling waarop de bestuursbevoegdheid berust of uit de aard van de overheidstaak zelf. (SER)
