Artikel 268 Gemw:

1. Een besluit dan wel een niet-schriftelijke beslissing gericht op enig rechtsgevolg van het gemeentebestuur kan bij koninklijk besluit worden vernietigd.
2. Ten aanzien van de vernietiging van een niet-schriftelijke beslissing gericht op enig rechtsgevolg zijn de artikelen 273 tot en met 281a alsmede de afdelingen 10.2.2 en 10.2.3 van de Algemene wet bestuursrecht van overeenkomstige toepassing.
