verbintenissenrecht (overeenkomstenrecht) - schade die opkomt doordat de afgeleverde zaak niet de eigenschappen bezit die de koper mocht verwachten. Gevolgschade, zoals letselschade, valt daarbuiten.


Artikel 24 Boek 7 BW:

1. Indien op grond van een consumentenkoop een zaak is afgeleverd die niet de eigenschappen bezit die de koper op grond van de overeenkomst mocht verwachten, heeft de koper jegens de verkoper recht op schadevergoeding overeenkomstig de afdelingen 9 en 10 van titel 1 van Boek 6.
2. Bestaat de tekortkoming in een gebrek als bedoeld in afdeling 3 van titel 3 van Boek 6, dan is de verkoper niet aansprakelijk voor schade als in die afdeling bedoeld, tenzij
a. hij het gebrek kende of behoorde te kennen,
b. hij de afwezigheid van het gebrek heeft toegezegd of
c. het betreft zaakschade terzake waarvan krachtens afdeling 3 van titel 3 van Boek 6 geen recht op vergoeding bestaat op grond van de in die afdeling geregelde franchise, onverminderd zijn verweren krachtens de afdelingen 9 en 10 van titel 1 van Boek 6.
3. Indien de verkoper de schade van de koper vergoedt krachtens lid 2 onder a of b, is de koper verplicht zijn rechten uit afdeling 3 van titel 3 van Boek 6 aan de verkoper over te dragen.
