procesrecht - het door een hoger gerecht ter behandeling terugsturen van een vernietigde rechterlijke uitspraak aan een lager gerecht. Meestal is dit een rechtbank in een andere jurisdictie, maar van dezelfde rang als de rechtbank die de vernietigde beslissing in eerste instantie heeft genomen. Bijv. eerder achtte de rechtbank Amsterdam het OM niet ontvankelijk, maar in hoger beroep heeft het Gerechtshof in Leeuwarden de zaak teruggewezen naar de rechtbank Utrecht.
