rechtswetenschap (rechtsgeschiedenis) - vóór de Tweede Wereldoorlog werd het bestuursrecht in de regel gezien als recht dat derogeerde aan het 'algemene' privaatrecht. Dit betekende dat het bestuursrecht te boek stond als ~ dat door de wetgever enkel tot stand werd gebracht in aanvulling op het algemene of 'gemene' privaatrecht dat de rechtsrelaties tussen burgers onderling (en tussen overheid en burger) reguleerde. Bijv. de Amsterdamse hoogleraar Vegting zag het administratief recht als uitzonderingsrecht op het civiele recht;recht(sgebied) dat geen enkel recht boven zich duldt, het algemene recht aan zichzelf onderwerpt en zelfs nieuw recht kan doen ontstaan.
